Basic Provisions

The data controller under Article 4, point 7 of Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (hereinafter: “GDPR“) is VIVIA s.r.o., ID No. 28978811, with its registered office at Ostrovského 253/3, 150 00 Prague-Smíchov, Czech Republic (hereinafter: “controller“).   1. Personal data refers to all information about an identified or identifiable natural person. An identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, identification number, location data, online identifier, or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural, or social identity of that natural person.

Types of Collected Personal Data

Only personal data necessary for the provision of offered services based on the fulfillment of a concluded contract or the legitimate interest of the controller is collected. This typically includes data such as:

  1. Name, surname, academic title, email, and phone number
  2. Data from the land registry
  3. For certain selected services (e.g., legal services, mortgage services, tax services, etc.), the following additional data is required: Permanent residence address, mailing address, date of birth, personal identification number or business identification number, bank account number, which are directly required by commercial banks, land registry offices, civil courts, or tax offices.

Purpose of Personal Data Processing

The processing of personal data is necessary for the fulfillment of a concluded contract or ordered service. Without specific personal data, it is not possible to validly conclude or even draft any contract or power of attorney in this sense.

Specifically, it concerns the following purposes:

  • Providing real estate services,
  • informing about the status of the provided real estate service or the development of the real estate case,
  • delivery of written documents related to the provision of real estate services.

Your email address or phone number is needed for phone or email communication and the fulfillment of certain specific services – e.g., sending information about the status of your real estate offer or demand, sending information about the development of real estate offers in our portfolio.

Legal Reason for Personal Data Processing

  1. The legal reason for the processing of personal data is the fulfillment of the contract between you and the controller according to Article 6, paragraph 1, letter b) of the GDPR (hereinafter “Contract Fulfillment”).
  2. The controller does not engage in automatic individual decision-making in the sense of Article 22 of the GDPR. You have given your explicit consent to such processing.

Personal Data Shared with Third Parties

Some selected services, such as legal services, tax services, mortgage services, auctions, or property purchases in execution, are carried out in cooperation with third parties according to the applicable legal regulations of the Czech Republic. Depending on the nature of the provided services, your selected personal data is shared with specific third parties. All our partners are bound by confidentiality obligations and may not use the provided data for any other purpose than for which it was disclosed.

If a client has not ordered any of our services that require cooperation with a third party, logically no data has been transferred to anyone (any third party)!

If you have only visited our website as visitors, we collect information about your computer through third-party applications. However, these data are anonymous. They cannot identify you as a person and are used only for the creation of statistics and their subsequent analysis.

Personal Data Processing Period

Personal data processing by the controller will take place for the duration of the contract or its legitimate interest.

Rights Related to Personal Data Protection

The client has the following rights in particular:

  • The right to withdraw their consent at any time,
  • the right to correct or supplement personal data,
  • the right to request a restriction on processing,
  • the right to object to or complain about processing in certain cases.

Cookie Issues

To operate and improve the website https://domovumore.cz, the operator uses so-called cookies. These small files are stored on your device through the browser when you open the internet address and allow better customization of the website.

What are “cookies”?

Facebook Issues

The Facebook pages of VIVIA s.r.o. are not only used for advertising purposes but also for providing information about the social activities of the named company and educational activities, e.g., in connection with articles on real estate. VIVIA s.r.o. is in no way legally responsible for the subsequent processing of these data by Facebook itself.

Infoline

In the case of the infoline, we only process the data of clients such as: Name, surname, academic title, email, and phone number, which lead to the realization of a real estate business case. Data of clients who are not interested in our company’s services are not processed, recorded, or logged at all.

XI.

Personal Data Protection

The controller has adopted and maintains technical and organizational measures to prevent unauthorized or accidental access to personal data, their alteration, destruction, or loss, unauthorized transfers, other unauthorized processing, as well as other misuse of personal data. These measures include:

  • Personal data anonymization,
  • access to personal data only for authorized persons of the controller,
  • a process of regular testing, assessment, and evaluation of the effectiveness of the implemented technical and organizational measures to ensure processing security,
  • multi-level firewall,
  • antivirus protection and control of unauthorized access.

Final Provisions

  1. By submitting your contact details through any of our contact forms or using the website www.domovumore.cz, you confirm that you are familiar with the principles of personal data protection and that you fully accept them.
  2. The controller is entitled to change these principles. The new version of the personal data protection principles will be published on the website: www.domovumore.cz
